 on des conceptions islamiques classiques en matière de commerce et de droi
 t commercial.\n\nRésumé\n\n[En anglais seulement] This workshop investigat
 es the place of moral considerations in shaping classical Islamic views on
  commerce and commercial law. The relation between morality and law is a q
 uestion that received much attention in modern jurisprudence\, and is ofte
 n used as a framework for analyzing the Islamic legal tradition. Nonethele
 ss\, not much has been said on the place of moral ideas in shaping laws go
 verning commercial exchanges in either tradition. While\, in modern law\, 
 it is sometimes claimed that positive morality is squarely opposed to capi
 talist-driven commercial laws\, studies on Islamic commerce tend to either
  offer descriptive accounts of the law\, or a historical narrative of econ
 omic stagnation.\n\nBy contrast\, this workshop will discuss the moral fra
 meworks constructed by a number of classical Muslim thinkers to allow a co
 nceptualization of commercial activity and a formulation of broad principl
 es that make sense of Islamic legal regulation of commerce. The talk will 
 make two central claims. Internally\, Islamic commercial law theory viewed
  morality as an effective yardstick against which the validity of transact
 ions could be measured. Externally\, the anchoring of law in a metaphysica
 l view of morality allowed for a more pervasive and multi-layered interven
 tion of moral ideas in commercial regulation than generally assumed in mod
 ern works on commercial law theory.\n\nLes Ateliers de droit civil\n\nEn v

 stauré la série des « Ateliers de droit civil » qui permet de regrouper de
 s juristes québécois et étrangers autour de thèmes de recherche communs. D
 édiés à l’étude d’un thème de recherche transversal\, les « Ateliers de dr
 oit civil » contribuent ainsi à enrichir et à stimuler la recherche fondam
 entale en droit privé.\n\nLe cycle 2018-2020 des Ateliers de droit civil\,
  présenté par le Centre Paul-André Crépeau de droit privé et comparé\, se 
 déroulera sous le thème « Les influences en droit privé ».\n\nLe cycle d'A
 teliers de droit civil compte sur l'appui financier du Fonds d’appui à l’a
 ccès à la justice dans les deux langues officielles du Ministère de la Jus
 tice du Canada.\n\nAucune inscription préalable n'est requise.\n\nChaque a
 telier est accrédité pour 1\,5 heure de formation continue obligatoire aup
 rès du Barreau du Québec et de la Chambre des notaires du Québec.\n
