It appears to us in texts and discourses that are thereby\nlegal phenom ena.\nPROGRAMME [.pdf]\nThis seminar originated from the advanced idea tha t these\nphenomena constitute law prior to the intervention of some system s\nof classification and exclusion themselves recognised as markers of\nla w. These phenomena constitute law even independently of those\nsystems. Th e idea came to mind while thinking about European law\;\nconsidering Europ ean contract law first\, and subsequently the\nteaching of European law. T he former\, beyond its scattered forms\,\nis the object of concurrent form alisations’ projects (legislations\,\nconceptualisations\, jurisprudence). The latter defines the subject\nof European law in Europe as well as else where. The universities\,\nacademies and institutes are considered to be t he places where\nEuropean law takes a typical form.\nIt might well be the case that the production and the diffusion\nof discourses and texts con-st ituting European law do not comply\nwith the rational organization of law\ , nor with the institutional\nstructures\, of which we teach the validity. This would mean that\nEurope is the stage of a diffuse struggle of intere sts\, and\neconomical and political models of develop-ment. This struggle is\n“diffuse” because it takes place outside of official frameworks\,\nwhi ch should legally monopolise discussions on European law.\nIt would also m ean that the question of Europe’s “legal\nconsolida-tion” should to be pos ed in a much more complex manner\nthan suggested by ideas of harmonization \, of legislation or of\ncodifi-cation.\nTheme 1.
