DESCRIPTION:Abstract\n\n\n\nHow did the pre-20th century Chinese justice sy
 stem deal with\nthe unintentional deaths of prisoners in their jails? Deat
 h by\njail\, the ‘accidental’ death of criminals awaiting punishment\, was
 \na common occurrence during the Qing dynasty (1644-1911)\, one that\nhas 
 been dismissed by many scholars of Chinese law and society as\nan unavoida
 ble aspect of pre-modern holding facilities. Yet\, even\nif the death of a
  large number of prisoners can be explained by\ncontemporary contagion sci
 ence\, what are scholars to make of the\nfact that under the Qing\, death 
 in prison\, even for a capital\noffense\, was considered a miscarriage of 
 justice? By looking at\nsome of the aspects of the institutional and legal
  structures of\nlate imperial Chinese justice that allowed for these death
 s\, and\nhow such deaths were dealt with by the imperial bureaucracy\, I\n
 consider how the Qing was able to construct the justice apparatus\nas a ma
 nifestation of imperial benevolence in the face of repeated\,\nindeed syst
