Justice Sachs is recognized for\nthe development of the d ifferentiation between constitutional\nrights in three different degrees o r generations of rights: from\nclassic civil and political rights to housi ng\, health\, education\,\nwelfare and the rights of future generations. I n this lecture\,\nJustice Sachs will discuss the enforcement of social\, e conomic and\nenvironmental rights in the judicial context. The key problem \nregarding the enforcement of these rights is not necessarily a\nquestion of judicial legitimacy. The real difficulty is most often\nthe institutio nal capacity of courts to enforce rights. Courts are\ninstitutionally unsu ited to take decisions on houses\, hospitals and\nschools. However\, court s are also inherently concerned with\nquestions of human dignity and oppre ssion. According to Justice\nSachs 'both freedom and bread are necessary f or the all-round human\nbeing. Instead of undermining each other\, they ar e related and\ninterdependent.'
